Blue Sky Stallion Services Pty Ltd
Blue Sky Stallion Services Pty Ltd ('BSSS') confirms that it will comply with the National Privacy Principles which form part of the Privacy Act 1988.
You are able to request details about the information BSSS holds about you and you have the right to correct any errors or omissions in this information. BSSS is bound by the National Privacy Principles set out in the Privacy Act 1988 (Cth.), which prescribes standards for the collection, disclosure and handling of personal information. We may vary this Privacy Policy from time to time.
Collection
BSSS is subject to certain legislative and regulatory requirements, which necessitate us obtaining and holding detailed information about you.
We may collect the following personal information:
- Name and address;
- Phone and fax numbers and email address;
- Tax file number;
- Australian Business Number (ABN) and/or Australian Company Number (ACN);
- Bank account details;
- If relevant, details as to status as a professional or wholesale investor under the Corporations Act 2001.
We will not collect any ‘sensitive’ personal information about you except when you have knowingly provided that information to us or authorised a third party to provide that information to us. Information held by us on individuals who are not clients will be similar to the above kinds of personal information and will typically be collected at the time of establishing the business relationship and subsequently.
Use and Disclosure
BSSS will only use the personal information we collect from clients for the purpose clients have provided it and for the purpose disclosed at the time of collection or otherwise as set out in this Privacy Statement. We will not use client’s personal information for any other purpose unless:
- directly related to the primary purpose of collection, and
- the individual would reasonably expect BSSS to use or disclose the information for this purpose, or
- client has given consent, or
- it is authorised or required by law. In this case, BSSS will make a written note of the use or disclosure;
- it is not sensitive information and the use of the information is for the secondary purpose of marketing;
- where we have reason to believe that unlawful activity has been, is being or may be engaged in, we may use or disclose your personal information as a necessary part of our investigation of the matter or in reporting our concerns to relevant persons or authorities;
- We reasonably believe that the use or disclosure of personal information is reasonably necessary by or on behalf of an enforcement body.
We will not disclose any information to any person without client approval unless it is in accordance with the Corporations Act 2001 or required by other laws or regulations.
Data Quality
BSSS will take reasonable steps to make sure that the personal information it collects, uses or discloses is accurate, complete and up-to-date.
Data Security
BSSS will take reasonable steps to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure.
BSSS will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for any purpose for which the information may be used or disclosed under the Use and Disclosure terms as above.

If you wish to complain about any breach or potential breach of this Privacy Policy or the National Privacy Principles, you should contact our Privacy Officer by any of the methods detailed above. Your complaint will be considered and responded to within 30 days. We will seek to address any concerns that you have through our Complaints Handling Processes, however, if you are unhappy with our response, you are entitled to contact the Office of the Federal Privacy Commissioner who may investigate your complaint further.
Openness
BSSS has set out this document to declare its policies on the management of personal information. This document is available to any person who asks for it.
Access and Correction
Personal information about a Client may be accessed by that individual unless prevented by circumstances such as if providing access would have an unreasonable impact on the privacy of other individuals or where denying access is required or authorised by law or an enforcement body.
We will not provide you with access to your personal information if:
- providing access would pose a serious threat to the life or health of a person;
- providing access would have an unreasonable impact on the privacy of others;
- the request for access is frivolous or vexatious;
- the information related to existing or anticipated legal proceedings between us and would not be discoverable in those proceedings;
- providing access would reveal our intentions in relation to negotiations with you in such a way as to prejudice those negotiations;
- providing access would be unlawful;
- denying access is required or authorised by or under law;
- providing access would be likely to prejudice certain operations by or on behalf of an enforcement body or an enforcement body requests that access not be provided on the grounds of national security.
In the event we refuse you access to your personal information, we will provide you with an explanation for that refusal.
Where a client requests access to their personal information which we hold, we may charge a reasonable fee to provide this access.
At all times we will endeavour to ensure that the personal information we hold about you is up to date and accurate. If you can show us that the Personal Information we hold is inaccurate, we will take all reasonable steps to correct the information. If we do not agree that your personal information requires correcting, we will take reasonable steps to ensure that whenever your personal information is accessed, that it is apparent you are not satisfied as to the accuracy or completeness of that information.
We will endeavour to respond to any request for access within 30 days depending on the complexity of the information and/or the request. If your request is urgent please indicate this clearly.
Identifiers
BSSS has its own identifiers of clients. It will not adopt other identifiers assigned by an agency or service provider, nor disclose this information unless for example the use or disclosure is necessary for the organisation to fulfil its obligations to an agency or external service provider.
Anonymity
It is not practicable to enter into transactions with BSSS while remaining anonymous.
Transborder Data Flows
Whilst BSSS may have clients from countries outside Australia, BSSS does not transfer personal information to countries other than Australia, other than to clients resident outside Australia.
Sensitive Information
BSSS will not collect sensitive information about individuals unless the individual has consented or it is required by law.
